These Terms of Service (“Terms”) govern your use of fibblewick.com and your purchase of products sold under the Fibblewick brand. Fibblewick is operated by 合同会社 Could up, a company established in Japan. By placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live if higher, to place an order. Our products may be designed for children, but our ordering and personalisation services are intended for adults.

Personalised Products

Fibblewick creates personalised products using information, photographs, and instructions submitted by customers. Because each product is individually created, reasonable differences may occur between digital examples, previews, illustrations, or screen representations and the final printed product.

Nothing in these Terms limits rights relating to products that are defective, materially incorrect, or otherwise fail to comply with mandatory consumer law.

Customer Content

“Customer Content” includes photographs, names, descriptions, text, instructions, and other materials submitted by you. You retain any rights you hold in your Customer Content.

By submitting Customer Content, you grant 合同会社 Could up and its relevant service providers a limited, non-exclusive licence to access, reproduce, crop, resize, format, modify, and otherwise process that content solely as reasonably necessary to create your personalised product, conduct quality checks, generate production files, manufacture the product, fulfil and deliver your order, provide customer support, produce an authorised replacement, and operate and secure our service.

Customer Responsibilities

By submitting Customer Content, you confirm that you have the legal right to provide it and, where it relates to a child, that you are the child's parent or legal guardian or otherwise have appropriate authority.

You must not submit illegal, abusive, exploitative, sexually explicit, hateful, threatening, or otherwise unlawful content.

Photographs and Image Quality

You are responsible for selecting photographs suitable for printing. Automated checks do not guarantee perfect print reproduction. Poor quality resulting primarily from a customer-supplied image will not automatically constitute a manufacturing defect where the printed product reasonably reflects the supplied image.

Orders

We may decline or cancel an order where reasonably necessary because of failed payment, suspected fraud, prohibited Customer Content, production limitations, technical problems, obvious pricing errors, shipping restrictions, or circumstances making fulfilment unlawful or impossible.

Prices and Payment

Prices are displayed on the applicable product page and during checkout. Applicable shipping charges, taxes, and other charges collected by us will be displayed during checkout.

Payments are processed using Shopify Payments and are generally due when an order is placed.

Production and Delivery

Fibblewick products are personalised and made to order. Production normally takes approximately 3–5 business days after the order and payment have been successfully confirmed.

Shipping begins after production is complete. Unless a different delivery timeframe is expressly disclosed before purchase, we aim to deliver orders within 30 days of order confirmation.

If we become aware that we cannot deliver an order within the applicable timeframe, we will contact you and provide any options required by applicable law, which may include agreeing to a revised delivery date or cancelling the affected order for a refund.

Changes and Cancellations

If you need to change or cancel an order, contact fibblewick@gmail.com as soon as possible. Once personalisation or production has begun, cancellation or modification may no longer be possible except where required by applicable law.

Refunds and Replacements

Because Fibblewick products are made to customer specifications and are personalised, change-of-mind returns are generally not accepted. This does not affect mandatory rights relating to defective, damaged, incorrect, misdescribed, or otherwise non-conforming products.

Intellectual Property

The Fibblewick name, website, logo, illustrations, designs, stories, layouts, graphics, and other materials created by or for Fibblewick are owned by 合同会社 Could up or its licensors unless otherwise indicated.

Third-Party Services

We use third-party services including Shopify, payment processors, print-on-demand manufacturers, fulfilment providers, and shipping carriers.

Limitation of Liability

To the maximum extent permitted by applicable law, Fibblewick and 合同会社 Could up will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable. Nothing excludes liability that cannot lawfully be excluded.

Governing Law

These Terms are governed by the laws of Japan. Nothing in these Terms is intended to deprive a consumer of mandatory consumer protections available under the laws of their country, state, or region of residence that cannot lawfully be waived.

Changes to These Terms

We may update these Terms from time to time. The Terms applicable to an order will generally be those in effect when the order was placed.
